These Terms of Use (“Terms”) govern your access to and use of Swim Sonar, a service provided by Bellwoods Labs Inc. (“Bellwoods,” “we,” “us,” or “our”). By accessing or using Swim Sonar, you agree to be bound by these Terms.
1. Eligibility and Access
Club Provisioning: Swim Sonar is a closed platform available only through participating swim clubs. Access is strictly limited to individuals authorized by a participating club or explicitly invited by an authorized parent or guardian. We reserve the right to deny or revoke access to anyone not properly authorized.
Minors: If a user is under the age of 18, a parent or legal guardian must agree to these Terms on their behalf. By authorizing a minor to use Swim Sonar, the parent or guardian accepts full responsibility for the minor’s use of the platform.
2. Account Responsibilities
Security: You access Swim Sonar via an email-based authentication code. You are responsible for maintaining the security of your email account. You agree not to share your access or allow unauthorized individuals to use your account.
Accuracy: You agree to provide accurate information when linking your account to a swimmer profile. Impersonating another person, claiming a swimmer profile that does not belong to you or your child, or improperly inviting unauthorized users is a material breach of these Terms and will result in immediate account termination.
3. Data Ownership and Content
Information Provided by Clubs: Participating clubs provide swimmer rosters, associated dates of birth, parent or guardian email addresses, meet results, and other information needed to operate Swim Sonar. Your club controls the roster, contact and meet information it provides to Swim Sonar. Requests to correct it go to your club.
Your Information: Your account and email address are yours. Bellwoods claims no ownership of them, except in aggregate form that identifies no club, family, or swimmer.
User Data: Swim Sonar has no feature for uploading content. You do not post anything to the app, and nothing you provide is displayed to other members of your club, so no licence over user content is asked for or granted.
Our Platform: The Swim Sonar app, website, and software belong to Bellwoods Labs Inc. Feedback you send us creates no claim on Swim Sonar.
Privacy: Our collection and use of personal information is governed by our Privacy Policy.
4. Cost
Free service. Meet tracking (results, entries, and splits) and records (personal bests and progress against published time standards) are free for authorized parents and swimmers.
Changes. If we change what is included in the free service or begin charging for it, we will give you at least 90 days’ written notice. You may stop using Swim Sonar during that time. You will not be charged for past use of the free service.
Optional services. If we offer other services for a fee, we will show the price before you choose to buy one. You will not be charged for a service you did not choose.
5. Disclaimers
Not Official Records: Swim Sonar displays results and standards from information provided by clubs or other sources. Swim Sonar is not an official record-keeping system. You must not rely on Swim Sonar for official entry deadlines, qualifying times, or formal meet results. Always verify critical information directly with your club or governing body.
As-Is Service: Swim Sonar is provided on an “AS IS” and “AS AVAILABLE” basis. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted access or error-free operation.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Bellwoods Labs Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, or data, whether incurred directly or indirectly, resulting from your use of Swim Sonar. In no event shall our aggregate liability for any claims relating to Swim Sonar exceed one hundred Canadian dollars (CAD $100.00).
7. Termination
You may terminate this agreement at any time by deleting your account. We may suspend or terminate your account at any time, without notice, for conduct that violates these Terms or is harmful to other users, us, or third parties.
8. Governing Law and Jurisdiction
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Ontario.
9. Modifications
Except for changes to the free service described in section 4, we reserve the right to modify these Terms at any time. Material changes will be communicated within the application. Continued use of Swim Sonar after changes take effect constitutes your acceptance of the revised Terms.
